Will my husband and children be able to get US citizenship?

I have American citizenship but have lived in Australia for 18 years, so I don't have American residency. If i get married will my husband and children be eligible for citizenship?





What if we wanted to live in the states, could they move back with me?Will my husband and children be able to get US citizenship?

well, luckily your kids are already US citizens because you are also a citizen. so they can come with you...with a valid US passport (same as what you or anyone would need to fly into the US)





your husband....you will have to file for a spousal visa..actually though, i was thinking that australia had one of those special types of tourist visas like england, where you dont have to apply. in this case, maybe he could come with you, and you could change is status to a spousal visa, and then he could eventually work after about 9 months. otherwise, he stays in australia, you and the kids move, and he comes when the visa is approved...again, anywhere from 5 to 18 months.





BUT...one of the qualifications for sponsoring your husband is that you must have an income over the poverty line...and show your previous year麓s tax returns to verifiy this...which you don麓t have. so....logic says you need to go to the US first and get a job!





i have heard there are ways around this.....such as having one of your parents sponsor him, or maybe you have a sibling. i think in your case, an immigration lawyer or consultant would be a good idea. also try visajourney.com
Your husband does not acquire citizenship by marriage.


Your children do acquire citizenship through you.





For your natural born children, If they were born outside US you need to file a Consular Report of Birth Abroad to register them as US Citizens.





For adopted children that have been in your custody for at least 2 years and for whom you have a Final Adoption Decree you can apply at the US Embassy for citizenship. They will need a visa to enter US legally as aliens for the final step in the process. Just checked Embassy site. Australia is a Visa Waiver Partner, so children can enter as Tourists on Visa Waiver in order to complete their application. More detailed instructions are available at US Embassy websites.





For your husband to acquire US Citizenship he will need to obtain a Green Card and be a Permanent Resident for a minimum of 3 years. Of those 3yrs, 18 months including the most recent 3 months must be spent in US. If he has less than 18 months in US or it has been less than 3 months since he last changed address or reentered US, then it is just a matter of waiting a little while until he meets the 18 month total %26amp; the 3 most recent month requirements.





His sponsor must reside in US. You can sponsor him if you can prove to the Embassy that you will have established a legal residence in US prior to approval of his visa. Form I-864 is the source of this requirement.
If you were an American Citizen, and did not officially ';revoke'; your citizenship. Then you are still a citizen. Your children (under 18 years of age) can automatically become citizens with filling out some forms. But your husband would need to live here for a couple years to be eligible to become a US citizen.
