Can my husband leave Turkey and join me in the UK and return later to do his national service?

Please Help. My husband is turkish and 28 years old. The problem is that he has not done his national service yet. He has a turkish passport and an uk settlement visa in it, so will he be able to leave turkey and join me in the uk easily or will he have problems?????

My ex-husband is Turkish. He was eligible for military service but joined me in the UK on a spouse visa in 1994 . He was never asked by the Turks or British to return to do military service. He returned to Turkey several times on his Turkish passport but was never asked about military service at passport control. A couple of years ago he was granted a British passport. He told me that since that point he longer had to do military service as he is now officially British and nothing to do with Turkey anymore. His Turkish passport expired. He regularly travels between the UK and Turkey but has never been asked to do military service there. He did not want to do military service because he is from a persecuted minority, that suffers bullying in the turkish army. He is now too old to be called up.





So I don't know what your other contributors are talking about.





I'm not sure though what the situation is if your hubby is still in Turkey now. I reckon he should be able to leave ok, he still has years to go before they might call him up. Best get him over here and apply for a UK passport as soon as possible. Unless he wants to do 2 years in the army? I think this up to Turkey. If the UK has granted him a visa then it is okay for him to enter (the UK doesn't care when he does his Turkish national service).





However, if the Turkish government demands he return and do national service, the UK will honour this request.





Coming to the UK is not a way to dodge Turkish law. So yes he can enter, and at anytime later within Turkish rules, he may return to do national service.
Yes he can go to UK and no he will not be deported to do military service but contrary to what someone else has put on here he will remain liable for national service even if he gets British passport .If he shows permanent residency in UK he can pay and do a one month spell in army which discharges his obligation .Many people have made multiple entries without problems then suddenly found themselves detained and in army.
He can go to the UK but if he ever attempts to return to Turkey they will put him in jail. They may take away his citizenship as well.





If Turkey manages to join the EU the UK may take away his status. NATO ties are still tight so it could happen either way. So basically even ten years from now he could have repercussions.





His choice and his gamble.

He must honour his military commitments and then when that is completed he can re -enter under the appropriate visa





Some people have been made to restart their immigration process all over again and others have had the process suspended until their commitment to the military was completed. Others were denied entry





He is a Turkish national and as such even if he was to enter UK as a spousal visa I can only tell you that the UK will deport him to honour his commitment to the armed forces of his country. If they are convinced that he is using his visa to avoid draft then they can and have rescinded settlement visas





The thing to remember he is that He is still a Turkish National and as such is still bound by his countries laws and military requirements.





See a solicitor that deals with immigration advise, check to see if you can have legal aid.

The UK Immigration laws all tightened up after 9/11 and further tightening since 7/7 bombings. Your husband has a settlemnt visa NOT a UK Citizship you need advice from the embassy if you do not then you both have to take your chances
