You file as married filing joint. It is a higher personal deduction. A spouse cannot be claimed as a dependent.
I believe you have to have a social security number in order for him to claim you, unless the laws have changed. But I would think it would be married filing jointly and you would both have to put your social security number on the tax return if he is going to claim you as an exemption.
Your husband has 3 ways to file.
1. Married filing jointly with you. $10,700 standard deduction, $6800 in exemptions and better tax rates. If you do not have an SSN or a ITIN, he would apply for one when you file. If you have any worldwide income, you would include it on the form.
2. Married filing separately without you. $5350 standard deduction, $3400 in exemption amount and not so good tax rates. If you do not have an SSN or a ITIN, he would file on paper and attach a note explaining that he isn't getting a tax benefit for you.
3. Married fiiling separately with you if you had $0 US source income. He would get $5350 standard deduction and $6800 in exemptions. Same lousy tax rates. If you do not have an SSN or a ITIN, he would have to attach form W-7 when he files.
4. If he has a minor child living with him, he *might* be able to file head of household. Too much to go into here.

YES he can !!!
under the law ur husband can claim you as a deduction in tax. it does not matters wether u are a citizen or not. but the time you have been married is also consider while giving tax benefit regarding spouse. which means when ur husband files his tax , the longer u guys would have been married the more the tax benfit.
